Terms and conditions of “#YouTalk Finance” event:

• “#YouTalk Finance” (“Event”) is organize by Bank of China (Hong Kong) Limited (“BOCHK”). All persons who participated in the "Trendy Banking" or "Stock Investment" category and submitted the application form to BOCHK within the Event application date, regardless of whether they were finally selected by the judging panel to enter the shortlisted primaries ("Participants") must read and comply with the following terms and conditions. When Participants complete the application, that means they agree and accept the following terms and conditions.
• Event application details:
  1. The Event application period is from 30 March 2023 to 26 April 2023 (both dates inclusive) (“Application Period”).
  2. Eligibility：
     - The Participants can join individually and / or via channel (must have a YouTube channel);
     - Aged 18 - 35 (Date of birth is 1 April 1987 to 1 March 2005), any gender;
     - Participants must hold a valid identity document, passport or birth certificate. (overseas participant must hold a valid Hong Kong entry permit to enter the competition)
  3. This Event not applicable to the staffs of BOCHK and its subsidiaries).
  4. The personal information provided by the Participants at the time of application must be true and correct. BOCHK has the right to verify the identity of the Participants. BOCHK is not liable for any failure to contact the Participants due to inaccurate or incorrect information provided by the Participants. In such case, the Participants will be automatically disqualified. Personal data provided by the Participants will be kept in confidential and it is only used for deal with matters related to this Event.
  5. The Participants are required to complete the application form during the Application Period and upload the application video to the designated link on or before 26 April 2023 as required to complete the application process, late submissions will not be accepted. BOCHK shall not be liable for any legal or other responsibility in relation to any delay, loss, error, illegibility or damaged in the information sent, upload or log in by the Participant due to technical issue such as computer or network. The Participant shall not dispute to the decision of BOCHK.
  6. The Participants cannot make changes once the application video is submitted.
  7. BOCHK will conduct shortlisted primaries based on the content of the short films submitted and select the finalists on or before Early May, 2023 (“Finalists”), BOCHK will announce / notify the Finalists via the Instagram Account TrendyToo Café (@BankingTrendyToo) for the competition.
• The competition date is from from May to June 2023 (“Competition Period”).
• The competition is divided into two categories, Trendy Banking and Stock Investment.
• The Finalists need to upload the competition video ("video") to the designated link of BOCHK according to the requirements of BOCHK according to different themes, schedules and formats for viewing and to apply for the boosting fee of the video on the YouTube platform. Once the application is successful, BOCHK will notify the Finalists to upload the video to their YouTube account and set it as "public", and forward the URL of the video to BOCHK.
• Scoring criteria:
  1. The competition will base on the "Video Content" and "Video Response" of the Finalists as the scoring criteria.
  2. The "Video Content" and “Video Response” are also divided into multiple scoring sub-item. The judges will give score to the Finalists according to the scoring criteria of each sub-item. In the end, the total score will be calculated according to the proportion of the score, and the total score will be used as the basis for the final award of the Finalists.

Total three winners will be selected from the two competition categories at the end of the competition. The prizes are as follow:

• Each Finalists can only receive one award (in the order of "Ace of Finance" > "Ace of Creativity" > “Ace of Progress”). If the finalist achieves the highest score for two or all three awards, they will receive the award in the aforementioned order, and the remaining awards will go to the next highest-scoring finalist.
• The personal information provided by all Participants must be true and correct. BOCHK has the right to verify the identity of the Participants. BOCHK is not liable for any failure to contact the Participants due to inaccurate or incorrect information provided by the Participants. In such case, the Participants will be automatically disqualified. Personal data provided by the Participants will be kept in confidential and it is only used for deal with matters related to this Event.
• The Finalists must follow the time schedule provided by BOCHK and upload their videos to the designated link for review. They must also apply to BOCHK for the advertising fees of the video on YouTube platform, and allocate the proportion of advertising fees required for each video on their own. Finalists only need to apply and notify BOCHK the percentage of advertising fees required for each video through inbox message to the BankingTrendyToo Cafe Instagram account (@BankingTrendyToo) at each time of uploading the video. All advertising fees must be used during the competition period, and late applications will not be accepted.
• The Finalists cannot make changes once all videos are submitted,
• BOCHK reserves the right to not accept any Video that is inappropriate or do not meet the Activity theme, requirements and specifications.
• The Finalists must agree and guarantee that all the filmed persons in the Video have agreed and authorized the relevant shooting (not involve copyright, patent right, portrait right, the rights related to personal information or any other intellectual property etc matter).
• The Finalists need to make sure their videos, graphics and music are legal and without any inappropriate content (including but not limited to not containing any content that may be understood as defamatory, indecent, obscene, offensive, abusive, invasive of another's privacy or intellectual property rights, controversial, discriminatory, intimidating, commercial, political, illegal, not suitable for any age of persons, violates or infringes the rights of third parties, or irrelevant to the theme of this Event, and try their best to ensure that the content is factual and not misleading). Otherwise, BOCHK reserves the right to request the Finalists to delete the relevant content immediately, disqualify the Finalists without further notice or reason and reserves the right to take a legal action. In case of any infringement, all legal responsibilities shall be borne by the Finalists / video / graphic providers. BOCHK will not bear any legal responsibility. The Finalists / video / graphic providers shall compensate and indemnify BOCHK for all damages and losses suffered thereby.
• All content of the Finalists’ videos, graphics and music represent their opinions only.
• All Finalists' user-generated content video (call as "UGC video") must be posted on their YouTube account and set as “Unlisted” during the Competition Period and within 3 months after the end of the competition (i.e. from Early May, 2023 to September, 2023) for public viewing and cannot be taken down.
• BOCHK reserves the right to disqualify individuals for violation or other reasonable reasons.
• BOCHK reserves the right to use the Finalists videos or works or materials related to the competition in their YouTube channel, production or edition of the promotional videos for the competition and distribute it to worldwide (online) at their sole discretion. BOCHK owns all distribution rights of the videos. The Finalists agree, authorize and confirm that BOCHK has and reserves the right to promote, edit, publish, distribute and use the videos, graphics and music provided by the Finalists.
• The result of the competition will be announced on or before July, 2023 on this website (https://www.bochk.com/ dam/investment/securities/youtalk/en.html) and Instagram account TrendyToo Café (@BankingTrendyToo).
• BOCHK will notify the winners for the prize collection arrangement according to the phone number of the winning Contestants ("Winners") provided at the time of application on or before July, 2023. The Winners must hold a valid BOC Credit Card. Free Spending Credit will be credited to the valid BOC Credit Card Account (exclude Supplementary Card) of the Winners on or before 31 December 2023. If the Winner does not hold a valid BOC Credit Card when BOCHK credit the Free Spending Credit, BOCHK reserves the right to disqualify the Winner or replace the original prizes with other prizes.
• BOCHK reserves the right to make the final decision for all Events. The Finalists shall have no objection to the competition results and the awards.
• This Event is subject to the information published on the website of BOCHK.
• Any disputes related to this event, social networking sites, all rights and responsibilities and all actions contemplated by these Terms and Conditions shall be governed by the laws of Hong Kong.
• Free Spending Credit is meant exclusively for retail purchase and cannot be used for cash advance, settlement of financial charge or any previous outstanding balance accrued before the Free Spending Credit is credited. Free Spending Credit cannot be converted into cash or exchanged for other gifts and is also not refundable and transferrable.
• The status of the credit card accounts held by the Winners should be normal, valid and in good standing, and such accounts should not have overdue / bad records, nor have they been cancelled / terminated for any reason, and the Winners should not have breached the Card User Agreement when the Free Spending Credit is credited by the BOC Credit Card (International) Limited (the “Card Company”). If the Winners cannot fulfil the above requirements, BOCHK and the Card Company reserve the right to forfeit the relevant Free Spending Credit without prior notice.

Disclaimer:
Without prejudice to any of the foregoing provisions, Participants must clearly understand and agree that BOCHK and its agents and contractors engaged for the execution and management of BOCHK's "#YouTalk Finance" Event shall not bear any legal responsibility for the following matters: (a) Any losses, costs, legal responsibilities and damages caused by the Participants who join "#YouTalk Finance" and distribute information, (b) Any indirect, incidental, special, consequential or exemplary damages, including but not limited to damages such as loss of profits, reputation, data or other intangible losses; even if BOCHK and its agents and contractors have been informed that the Participants may cause the aforementioned damages are no exception.

Statement of interest distribution between two parties:
Participants agree to discuss with BOCHK before proceeding the following matters:

• Participants work on the videos all related to the same type project.
• Any intellectual property revenue generated in or from the video (YouTube advertising dividends are not counted).
• The videos used for "#YouTalk Finance" are not allowed to be used on other platforms (excluding Participants' personal channels) without the consent of BOCHK.

General terms:

• By accepting the above terms, conditions and statements, you have read, understood and agreed to be bound by the above terms, conditions and statements.
• Should there be any discrepancy between the English and Chinese versions of this promotion material, the Chinese version shall prevail.
