BoC Pay Cross-Border 5% Cash Rebate at Mainland merchants promotion (the “Promotion”) Terms and Conditions:
1. The Promotion is valid from 29 August 2023 to 31 December 2023, both dates inclusive (the "Promotion Period"). The promotion period will be divided into 2 phases:
Phase 1: Promotion from 29 August to 30 September 2023.
Phase 2: Promotion from 1 October to 31 December 2023
2. The Promotion is applicable to QR Code payments made with the BoC Pay mobile app (the “BoC Pay”). The customers must successfully bind the BoC Pay mobile app with a BOC UnionPay Credit Card (the “Eligible Credit Card”) issued in Hong Kong bearing the logo (the “Eligible Customers”).
3. During the Promotion period, an Eligible Customer can enjoy 5% Cash Rebate to settle eligible transaction via BoC Pay at physical retail merchant stores in Mainland (the “Eligible Transaction”). Eligible transaction refers to a transaction via UnionPay network during the Promotion Period.
4. The cash rebate is calculated based on the spending amount of eligible customers during the promotion period. Eligible Transaction does not include online merchants. The rebate of phase 1 will be credited the customers’BOC UnionPay Credit Card on or before 30 November 2023. The rebate of phase 2 will be credited the customers’BOC UnionPay Credit Card on or before 29 February 2024. All Eligible Transactions will be counted based on the transaction date, must be completed during the Promotion Period. The total awarded cash rebate shall be rounded to the nearest dollar. There is cash rebate cap in each promotion phase. And for each phase, the cash rebate cap would be HK$1,000. For Eligible Retail Spending at Physical Store, with a BOC UnionPay Credit Card via BoC Pay in Renminbi (RMB), every RMB1 spent will be calculated as HK$1.
5. Eligible Transactions made with a supplementary card will be combined with those from the main card to calculate towards the cash rebate. All Eligible Credit Card accounts of the cardholder will be automatically combined for the calculation of the Offer.
6. An Eligible Customer whose eligible credit card account and/or BoC Pay account are valid and in good standing, and whose BoC Pay account is bound with an eligible credit card during the entire Promotion Period and at the time the cash rebate is being awarded, will be eligible for the Promotion. In the event of violation of the Credit Card User Agreement and/or Credit Card Agreement, termination of a credit card account, overdue payment or bad record, or forfeiture of the cash rebate during the Promotion or at the time the cash rebate is being awarded, the cash rebate will be cancelled automatically forthwith.
7. Any cancelled / refunded / falsified / unposted / split transactions / unauthorized transactions are not counted as eligible transactions. The offer will be cancelled or refunded in all ineligible transactions. Bank of China (Hong Kong) Limited ("BOCHK") and / or BOC Credit Card (International) Ltd (the "Card Company") reserve the right to debit the relevant Credit Card with the amount equivalent to the value of the Offer without prior notice to the customer.
8. The cash rebate promotion is subject to the record of BOCHK and/or Card Company. BOCHK and/or the Card Company will determine the eligibility of each transaction by matching the customer transaction records held by BOCHK and/or the Card Company and the relevant data provided. If the information from the customer differs from those of BOCHK and/or the Card Company records, the latter shall be final and conclusive.
9. The Cash Rebate is meant exclusively for retail purchase and cannot be used for cash advance, settlement of financial charge or any previous outstanding balance accrued before the Cash Rebate is credited. The Cash Rebate cannot be converted into cash or exchanged for other gifts and is also not refundable and transferrable.
10. Customers are responsible for the data charges of using and / or downloading BOCHK Mobile Application imposed by their service providers.
11. Please download the BoC Pay mobile app from official application stores or the BOCHK website, and ensure the search wording ("BoC Pay"). iPhone users may download the BoC Pay via the App Store; Android users may download BoC Pay via Google Play, HUAWEI AppGallery or BOCHK website.
12. By using the BOCHK Mobile Application, the customer agrees to be bound by the contents of the relevant disclaimer and privacy policy posted on the BOCHK Mobile Application and which may be updated by BOCHK from time to time. 13. Recommended Operating Systems for BoC Pay: iOS (14.0 or above) and Android (8.1 or above).

15. By participating in this Promotion, the customer acknowledges that he/she has read, understood, accepted and agreed to be bound by these Terms and Conditions.
16. The above products, services and Offers are subject to the respective terms and conditions, please refer to in-store promotional materials or enquire with the Merchant or staff of BOCHK and / or the Card Company for details.
17. No person other than the cardholders, BOCHK and / or the Card Company will have any rights under the Contracts (Rights of Third Parties) Ordinance to enforce or enjoy the benefits of any of the provisions of these terms and conditions.
18. BOCHK and / or the Card Company are not the suppliers of the Merchant. Relevant products and / or services are provided by the Merchant. Any enquiries or disputes relating to the goods and the services should be directed to the Merchant. BOCHK and / or the Card Company and / or UnionPay International accept no liability for the quality of or any other matters relating to the goods, products and services provided by the Merchant. The Merchant is solely responsible for all obligations and liabilities relating to the goods, products and service.
19. BOCHK and / or the Card Company and / or UnionPay and / or the Merchant reserve the right to change, suspend or terminate the terms and conditions at its sole discretion.
20. In case of any disputes, the decision of BOCHK and / or the Card Company and / or the Merchant shall be final and binding on all parties concerned.
21. Should there be any discrepancy or inconsistency between the English and the Chinese versions of these terms and conditions, the Chinese version shall prevail.
